Apologies for absence had been received from Cllrs Patricia Ellis and Tony Gordon-Smith.  Cllrs Elizabeth Cable and Peter Isherwood attended as substitutes.

Exclusion of Press and Public

To consider the following recommendation on the motion of the Chairman:-

 

Recommendation

 

That pursuant to Procedure Rule 20 and in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of the following items on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the public were present during the items, there would be disclosure to them of exempt information (as defined by Section 100I of the Act) of the description specified in paragraph 1 of the revised Part 1 of Schedule 12A to the Act in respect of the following item:

REVIEW OF HACKNEY DRIVER'S LICENCE WITH REFERENCE TO A SERIOUS INCIDENT

To consider the attached Exempt report.

The driver attended the meeting to be interviewed by the Sub-Committee and to present his case.  He was accompanied by his wife and solicitor.  The driver confirmed that the agenda papers had been received and understood.

 

The driver’s solicitor informed the Sub-Committee that her client had pleaded Not Guilty at the Magistrates Court to the alleged offences and a trial session had been set for a later date to hear the case.

 

In the light of questions over witness statements the driver’s solicitor invited the Sub-Committee to adjourn the hearing until after the trial session in the Magistrates Court.

 

The Sub-Committee WITHDREW at 10.39 to consider whether to continue with the hearing or adjourn until after the trial session.

 

Following the Sub-Committee’s deliberation the meeting RESUMED at 11.41.  The Council’s Legal Adviser had been asked to advise the Sub-Committee during their deliberation on the wording of their decision.

 

RESOLVED    that, in view of the fact that the Sub-Committee concluded that it would be premature to hear the matter at this time, it be adjourned until the next available Sub-Committee meeting following disposal of the charges.
