Minutes:

Cllr Robert Knowles was elected as Chairman for the purposes of this meeting.

LICENSING ACT 2003 - APPLICATION FOR A STREET TRADING LICENCE - STOCKLUND SQUARE, CRANLEIGH pdf icon PDF 1 MB

To determine a new application for a licence to trade in a designated consent street.

 

Recommendation

 

2.1       The Licensing Committee reviews consultation feedback and determines the application of Diane Savage of Swurls (a mobile food business offering rolled icecream) for a consent to trade at in Stocklund Square, Cranleigh.

 

2.2       The Licensing Committee delegates the authority to the Head of Environmental and Regulatory Services, in consultation with the Chair and Vice Chair, to revoke street trading consents in the event that any new business granted a Street Trading Consent does not achieve a Food Hygiene Rating Score of level 3 or above within three months of the grant of the consent.

Reasons

 

After taking into account the written representations from the parties and the oral representations from parties at the hearing, the Sub Committee considered the concerns raised in the objections to the application from a Ward Councillor and local business owners as well as the comments in support from the Parish Council. The Sub Committee also considered the comments from the Parish Council, that it provided a valued service locally.

 

In reaching its decision the Sub Committee considered the Street trading policy and the Local Government (Miscellaneous Provisions) Act 1982 - Schedule 4 Street Trading.

 

Right to appeal

 

A person aggrieved by the decision of the Licensing Sub Committee may make an application to the High Court for judicial review of the decision.
