To elect a Chairman for the purposes of the meeting.

Cllr Michael Goodridge was elected Chairman for the purpose of the meeting.

The purpose of the report is to enable the Sub-Committee to consider an application for a new Premises Licence for Kilnside Farm Shop, Kilnside Farm, Moor Park Lane, Farnham, Surrey GU10 1NS under section 17 of the Licensing Act 2003. Four relevant representations have been received from ‘other persons’.

Recommendation

·      It is recommended that the Sub-Committee considers the application and evidence of all parties involved at the hearing and then determine the application.

·      Members must determine the application in accordance with the Licensing Act 2003 (Hearings) Regulations 2005.

·      The Sub-Committee should take such steps (as described at paragraph 8.11 below) as it considers appropriate for the promotion of the licensing objectives.

Once determined, the licensing authority must provide notification of the decision including its reasons to the applicant, any person who has made relevant representations and the Chief Officer of Police for the area in which the premises is situated.

The Committee considered carefully the papers, representations received and comments made during the hearing as well as the Licensing Act 2003 and the Statement of Licensing Policy in relation to the new application.

The Committee was not able to consider matters of planning and or property.

The Committee heard from the applicant who outlined arrangements in relation to storage of alcohol and that there was cctv at the site. The scale of the operations at the site were also set out and as in the application the establishment did not intend to open for the off-sale of alcohol outside the existing hours when meat and other farm grown products were made available. It was noted that parking was to be made available at the site within the courtyard area.

The Committee noted in particular that no representations had been received from responsible authorities, and that products were already available at the premises by appointment.  

Consideration was given to the representations received on the basis of potential issues relating to public nuisance and safety. This included concerns regarding potential noise, increase in traffic and concerns of incremental activities. However, it was felt that those reflected concerns rather than firm evidence of any particular issues which needed to be addressed and or which engaged the licensing objectives.

In those circumstances, the Committee felt that that no further steps or conditions were necessary in order to promote the licensing objectives and the application was granted for off sales between the hours of 10 and 6pm daily.
