The minutes of the meeting which took place on 21 August 2017 were confirmed and signed.

LICENSING ACT 2003 - APPLICATION TO VARY A PREMISES LICENCE - TESCO EXPRESS, 29/31 RIDGWAY ROAD, FARNHAM SURREY GU9 8NN pdf icon PDF 79 KB

The purpose of the report is to enable the Sub-Committee to consider an application

 for a variation to the premises licence of Tesco Express, 29/31 Ridgway Road,

 Farnham, Surrey GU9 8NN made by Tesco Stores Ltd, the current premises licence holder. Two relevant representations have been received from ‘other persons’.

 

Recommendations

 

It is recommended that

 

1.         the Sub-Committee considers the application and evidence of all parties involved at the hearing and then determines the steps it considers appropriate to promote the licensing objectives as described in the paragraph above.

 

2.         Members determine the application in accordance with the Licensing Act 2003 (Hearings) Regulations 2005.

The Sub-Committee carefully considered the application for a variation to the premises licence, taking into account the representation(s) received, statutory guidance and the Council’s Statement of Licensing Policy 2013-2018.

 

The Sub-Committee agreed to grant the variation to the licence as it did not consider that there was sufficient substantiated evidence to reject the application on the grounds of Prevention of Crime & Disorder or Prevention of Nuisance

 

In granting the application the Sub-Committee noted that there were no representations from the police for antisocial behaviour nor had environmental health made objections for public nuisance. The Sub-Committee heard from the applicant that there had only been one complaint since November 2017 regarding a delivery being early and the Sub-Committee was satisfied that the store had procedures in place to prevent this happening again. The Sub-Committee was also satisfied by what it heard from the applicant regarding its good neighbour policy and was pleased to hear that they would be in contact with the Local Ward Councillor, Cllr Sam Pritchard to discuss concerns.  

 

In relation to the conditions, the Sub-Committee imposed the existing conditions with one amendment that Think 21 be changed to Think 25.
