APOLOGIES FOR ABSENCE AND SUBSTITUTES

Where a Member of the Committee is unable to attend a substitute Member may attend, speak and vote in their place at that meeting.

 

Members are advised that in order for a substitute to be arranged a Member must give four (4) clear working days notice of their apologies.

 

For this meeting the latest date apologies can be given for a substitute to be arranged is 9November.

Officers to update the Committee on any changes to the planning environment of which they should be aware when making decisions.

The Committee were advised that the latest position on the Councils 5 year land supply had been published and as of 1 April 2021 there was a 5.2yr land supply.

CONFIRMATION OF TREE PRESERVATION ORDER (NO 08/21) - GROUP OF SCOTS PINE TREES AT 75 SHORTHEATH ROAD, FARNHAM, GU9 8SF pdf icon PDF 904 KB

To consider the objection to making of a Tree Preservation Order (TPO) 08/21 and to determine whether the Order should be confirmed, with or without modification.  The report has no direct resource implications.  There are environmental benefits in retaining the tree group which merits special protection.

 

Recommendation

 

It is recommended that the Tree Preservation Order 08/21 applying to a group of 3 Scots Pine trees in the rear amenity area of the property of 75 Shortheath Road, Farnham, GU9 8SF be CONFIRMED without modification.

 

 

Decision:

To consider the objection to making of a Tree Preservation Order (TPO) 08/21 and to determine whether the Order should be confirmed, with or without modification.  The report has no direct resource implications.  There are environmental benefits in retaining the tree group which merits special protection.

Recommendation

 

That, subject to the completion of an appropriate legal agreement, within 6 months of the date of the committee, in respect of the Thames Basin Health SPA, and subject to conditions 1-13, permission be GRANTED.

Planning Permission was REFUSED  as the provision of three additional gypsy pitches would result in a cramped and crowded appearance comprising of over development of the site and be harmful to the character and appearance of the area. The application would therefore compromise the role of the Farnham and Aldershot strategic gap and fail to comply with Policies DD1 and I1 of Local Plan Part 1 2018,  Farnham Policies FNP1, FNP10, FNP11 of the Farnham Neighbour Plan and Policies D1 and D4 of the Local Plan 2002.

 

The proximity to the pitch in the northeast corner site will result in an unacceptable relationship between developments with the potential for harmful noise and disturbance to the future occupiers of the neighbouring development proposal contrary to policies TD1 of the Legal Plan Part 1, Policy FNP1 of the Farnham Neighbourhood Plan and Policies D1 and D4 of the Local Plan 2002.

 

Minutes:

The Committee were advised that it was proposed that:

·         condition 3 be amended to include, none of the proposed new mobile homes will be occupied until the detailed landscaping scheme to include gates fences and any other means of enclosure has been submitted to and approved in writing by the local planning authority.

·         conditions 10, 11 and 12 be removed as they are not relevant to this application; and

·         condition 13 (which would now become 10) be changed to state that no more than two caravans as defined in the caravan sites and control development act 1960 and the caravan sites act 1968 as amended comprising one static caravan and one touring caravan shall be sized on each of the pitches hereby approved at any time unless otherwise agreed in writing by the local planning authority.

 

The Committee considered the application and voted none for, 10 against and 1 abstention. Therefore the officer recommendation was lost.

 

Cllr Jerry Hyman proposed an alternative recommendation to refuse and was seconded by Cllr Carole Cockburn. The Committee voted 10 in favour, one against and 1 abstention, therefore the alterative recommendation was carried

 

Decision
