APOLOGIES FOR ABSENCE AND SUBSTITUTES

To receive any apologies for absence and substitutes.

 

Where a Member of the Committee is unable to attend a substitute Member may attend, speak and vote in their place at that meeting.

 

Members are advised that in order for a substitute to be arranged a Member must give four (4) clear working days notice of their apologies.

 

For this meeting the latest date apologies can be given for a substitute to be arranged is Tuesday 1st December 2020.

Proposal

 

Erection of a detached dwelling (as amplified by letter received 10/09/2020 and amended by plans received 28/09/2020)

 

Recommendation

 

That, subject to conditions 1-14 and informatives 1-15, permission be GRANTED

Decision:

Planning permission REFUSED for the following reasons:

 

1.    The proposed dwelling by virtue of its size, scale, mass, design and location forward of the building line of 2 Jacaranda Cottages would comprise an undesirable development of the site and would be detrimental to the character and appearance of the area and by reason of its close proximity to the common boundary, in combination with its height and mass, would appear overbearing and result in a loss of light and outlook detrimental to the meaning of the occupiers of 2 Jacaranda Cottages and would therefore fail to comply with Policy TD1 and Retain Policies D1 and D4 of the Local Plan, the Council Residential Extensions SPD and the National Plan Policy Framework.

 

2.    The proposed development would fail to provide on-street vehicular parking spaces to meet the requirements of Waverly Borough Council parking guidelines furthermore it's not considered to be served by an appropriate provision of alternative services which would reduce the requirement for parking. Consequently the proposed development would be likely to result in inconvenience to surrounding residents as a result of on-street and public car parking. The proposal would therefore fail to comply with Policy TD1 of the Local Plan, Retained Policies D1 and D4 of the 2002 plan, the parking guidelines and section 9 of the NPPF.

 

3.    It has not been demonstrated that there would be insufficient access and space on site, during construction, for vehicles to park and turn around so they can enter and leave in a forward gear. This could result in the obstruction of free flow and safe flow of traffic and inconvenience of pedestrians contrary to the objectives of policy ST1 and section 9 of the Planning Policy Framework.

Public Speaking

 

In accordance with the Council’s public speaking scheme, the following made representations which were duly considered:

 

Martin Birt (Agent) – In support

 

Cllr Jerry Hyman – Waverley Councillor who had registered to speak on this item.

 

The recommendation to grant planning permission subject to conditions 1- 14 and informatives 1- 15, was overturned by a vote of none in favour, 14 against and no abstentions.

 

An alternative recommendation to refuse the application was proposed by Cllr Peter Isherwood, seconded by Cllr carole Cockburn and was carried by a vote of 13 in favour, one against and no abstentions.

 

Decision

To consider the following recommendation on the motion of the Chairman:

That, pursuant to Procedure Rule 20 and in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of the following item on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the public were present during the item, there would be disclosure to them of exempt information (as defined by Section 100I of the Act) of the description specified at the meeting in the revised Part 1 of Schedule 12A to the Local Government Act 1972
