Councillor Ellis declared a pecuniary interest with regard to item 8.2 WA/2022/00657 - REAR OF DAVID MANN AND SONS LTD 101 HIGH STREET CRANLEIGH As a trustee of Rowleys Centre for the Community, Victoria Road, Cranleigh, which is in very close proximity to the proposed development.  Councillor Ellis advised the Committee that she would therefore withdraw herself from discussions and voting on the application.

Recommendation A That, subject to the applicant entering into an appropriate legal agreement within 6 months of the Committee date to include an obligation precluding the applicant for implementing the permission in conjunction with the mobile home proposed under application WA/2020/1186 (currently the subject of an extant appeal with the Planning Inspectorate) and conditions 1-12 and informatives 1-6 in the agenda report, plus additional conditions (13) removing permitted development rights for extensions under Schedule 2, Part 1, Classes A & B of the GDPDO 2015, as amended, and (14) requiring the applicant to submit a scheme of sustainable construction and carbon reduction measures to the local planning authority for approval and the development to thereafter proceed in accordance with these approved details, permission be GRANTED.

 

Recommendation B That, in the event that a suitable legal agreement as required under Recommendation A is not competed within 6 months, permission be REFUSED on the grounds that granting planning permission could result in two separate agricultural worker’s dwellings being present on the site, whereas agricultural justification has only been provided for the need for one such unit, and this outcome would fail to safeguard the intrinsic character and beauty of the countryside and Area of Great Landscape Value, and the setting of the Surrey Hills Area of Outstanding Natural Beauty to the north.

Informative 13 – The applicant is encouraged to undertake this development in accordance with the principles of the Considerate Contractor Scheme.

 

Informative 14 – The Tree Protection Plan and Arboricultural Method Statement (AMS) required under condition 4 should include measures for the protection of the existing important Yew tree as identified in the submitted plans.
