Minutes:

Councillor Goodridge declared a non-registrable interest in Item 8.2 as he lived close to the site and would leave the Chamber during consideration of the item.

 

Councillor Baker declared a non-registrable interest in Item 9.1 due to a conflict of interest and would leave the Chamber during consideration of this item.

APPLICATIONS NOT SUBJECT TO PUBLIC SPEAKING

9.1

B1 - WA/2021/01856 - LAND CENTRED COORDINATES 504068 134671 EAST OF LOXWOOD ROAD, ALFOLD pdf icon PDF 4 MB

Approval of Reserved Matters (Appearance, Landscaping, Layout and Scale following Outline Permission granted under WA/2019/0745 for the erection of up to 80 dwellings (including 24 affordable) with associated landscaping, open space and SUDs (as amended by plans received 22/02/2022)

 

Recommendation A

 

That, subject to the completion of a Deed of Variation by 9th September 2022 to secure amendments to the affordable housing mix, market housing mix and location of the LAP, the reserved matters of layout, scale, appearance and landscaping be APPROVED, subject to conditions and the completion of a Deed of Variation

 

Recommendation B

 

That, in the event that the requirements of Recommendation A are not met, permission be refused.

 

Decision:

RESOLVED that, had the Committee been in a position to determine the application, planning permission would have been REFUSED for the following reasons:

 

1)    The proposed development, by reason of its density, layout (including road layout) and scale would have a cramped and crowded appearance, that would be out of keeping with the character of the area and would have a harmful impact on visual amenity, contrary to Policy TD1 of the Local Plan Part 1 (2018) and Policies D1 and D4 of the Local Plan 2002.

 

2)    The design of the dwellings, particularly the flatted building, would be out of keeping with the character and appearance of the area and would have a harmful impact on visual amenity, contrary to Policy TD1 of the Local Plan Part 1 (2018) and Policies D1 and D4 of the Local Plan 2002.

 

3)    The proposed development, by virtue of the provision of car parking spaces adjacent to the boundary with no. 15 Chilton Close, would have a harmful impact on that property with regard to noise and general disturbance, contrary to Policy TD1 of the Local Plan Part 1 2018 and Policies D1 and D4 of the Local Plan 2002.

 

4)    The proposed development would not provide a mixed and balanced communities as a result of the poor distribution of affordable housing within the development, contrary to paragraph 63 of the NPPF 2021 and Waverley’s Affordable Housing Supplementary Planning Document April 2021.

 

5)    The proposed development is deficient in playspace provision due to the lack of provision of a Locally Equipped Area of Play on the site itself, harmful to the amenities of future occupiers, contrary to Policies TD1 and LRC1 of the Local Plan Part 1 (2018).

 

Minutes:

Councillor Goodridge returned to the Chamber.  Councillor Baker left the meeting.

 

The Chairman called a short adjournment at 7.20pm.  The meeting resumed at 7.25pm.

 

Proposal

 

Approval of reserved matters (Appearing, Landscaping, Layout and Scale following outline permission granted under WA/2019/0745 for the erection of up to 80 dwellings (including 24 affordable) with associated landscaping, open space and SUDs (as amended by plans received 22/2/22).

 

The Committee noted that the application had been appealed on the grounds of non-determination. Upon receipt of the appeal, the Planning Inspectorate became the determining authority. Therefore, the Council could no longer issue a formal decision on the application.

 

However, regardless of the appeal and in order to decide how the Council was to proceed, the Committee was invited to consider the application in the normal way with a view to issuing a decision setting out what the Council would have done should the Council have been in a position to determine the application; and that a non-formal decision is issued to the applicant and the inspectorate following the meeting.

 

The report was considered by the Committee.

 

Following the debate, Councillor Deanus proposed, seconded by Councillor Follows, that, had the Committee been in a position to determine the application, it would have been refused.  The Chairman moved to a vote and the Committee voted 10 for, 1 against and 0 abstentions.  Councillor Follows left the meeting.

 

RESOLVED that, had the Committee been in a position to determine the application, planning permission would have been REFUSED for the following reasons:
