The minutes of the last meeting on 16th December 2020 were noted.  The Chairman would sign the minutes when the Covid-19 pandemic had abated.

Minutes:

Councillors Goodridge and Cosser declared personal interests in relation to item A1 because they knew the applicant .   Councillors Townswend and Follows declared personal interests as they knew the applicant, Mr Taylor, through their council work due to his work on the Chamber of Commerce.  None of these declarations precluded these councillors’ right to vote on the item.

ANY RELEVANT UPDATES TO GOVERNMENT GUIDANCE OR LEGISLATION SINCE THE LAST MEETING

Officers to update the Committee on any changes to the planning environment of which they should be aware when making decisions.

 

Minutes:

 A High Court judgement had taken place in December 2020.  The judge quashed the granting of planning permission for 73 dwellings near a heritage asset in Guildford.  It was found that an officer had seriously misled the planning committee.  The judge found that the officer did not advise members on how they were required to apply the duty under Section 66(1) of the Listed Buildings and Conservation Act 1990. 

 

In an earlier different case (Barnwell), it had been previously established that Section 66(1) imposed a duty to treat harm to a listed building as a consideration to which the decision maker must give considerable importance.  It was open to the decision maker to give the harm such weight as they saw fit.

 

In the Guildford case the officer was found to have made repeated errors in advising members weighing harm to the heritage assets against the public benefits of the proposal.  The judge concluded that had the Committee known that they should attribute due weight to the identified harm that they could have come to a different decision so the planning decision was quashed.  This was particularly relevant to item A1 on the present agenda.  The officer responsible for A1 was satisfied that the report took into consideration the points raised by the High Court judge.

 

The second update for members was to let them know that on 20 January 2021 the Government released the latest housing delivery test results.  The Council achieved 98% delivery against its housing targets.  As a result it now had to apply a 5% buffer to its primary housing land supply position.  The Council published its Position Statement on Housing Land Supply in October 2020 with a base date of 1 April.  The document set out the housing land supply for 5.3 years including that 5% buffer.  It can therefore demonstrate that the requirements of paragraph 73 of the NPPF have been met.

 

There had also been consultation by the Government relating to support for housing delivery and public sector infrastructure.  The consultation closed on 28th January 2021.  The Council had submitted its response which would shortly appear on its website.
