Cllr Val Henry declared a pecuniary interest in item A1, Hunters Rest, and  left the chamber while the item was considered.

 

Cllr Patricia Ellis declared a non-pecuniary interest in item A3, Penwerris, she considered the interest to have sufficient weight that, in the interest of public perception, she left the chamber while the item was considered.

 

Cllrs Jeanette and Stewart Stennett declared a pecuniary interest in agenda item 10 and left chamber while the item was considered.

Planning Performance and the Government target on quality on planning decision making will now be a standard item on the Area Planning Committee agenda. This was an agreed recommendation at Executive on 28 November 2017 and is part of the Development Management Service Improvement Plan.

 

The latest available statistics will be included with the update sheet.

Recommendations

 

RECOMMENDATION A:

 

That, subject to a Section 106 Agreement to secure a financial contribution towards affordable housing and recycling containers, conditions 1 – 28 and informatives 1 – 19, permission be GRANTED.

 

RECOMMENDATION B:

 

That, in the event that a Section 106 Agreement is not completed within 6 months of the resolution to grant permission, permission be REFUSED.

Decision

 

RESOLVED that permission be GRANTED subject to a Section 106 Agreement to secure a financial contribution towards affordable housing and recycling containers, conditions 1 – 28 and additional conditions 29 – 30 set out below, as well as informatives 1 – 19.

 

29.       Condition

Prior to the first occupation of the units hereby permitted, a scheme for the provision of electric vehicle charging points in relation to outdoor parking spaces and the indoor buggy store within the application site shall be submitted to and approved in writing by the Local Planning Authority. Electric vehicle charging points shall be installed on site prior to the first occupation of the units in strict accordance with the approved details.

         

Reason

To support users of low and ultra low emission vehicles and enable charging in convenient locations, in accordance with Policy ST1 of the Local Plan 2018 (Part 1) and paragraph 110 of the NPPF 2018 and having regard to Surrey County Council’s Vehicular and Cycle Parking Guidance (January 2018).

 

30.       Condition

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any other Order revoking or re-enacting that Order with or without modification), no development as defined within Part 1 of Schedule 2 Class B of the order shall be implemented on the site without the written permission of the Local Planning Authority.

 

Reason

In the interests of the visual and residential amenities of the area in accordance with Policy TD1 of the Local Plan 2018 (Part 1) and retained Policies D1 and D4 of the Waverley Borough Local Plan 2002.

 

RESOLVED that in the event that a Section 106 Agreement is not completed within 6 months of the resolution to grant permission, permission be REFUSED.

Decision

 

RESOLVED that permission be REFUSED for the following reasons.

 

1.    Having regard to the indicative plans submitted, the Council is not satisfied that the proposed development could be accommodated on site in an acceptable manner without causing harm to the intrinsic character and beauty of the Countryside, the rural character of the area and the tranquillity of surrounding rural roads. The proposal would therefore conflict with Policies RE2 and TD1 of the Local Plan 2018 (Part 1) and retained Policies D1 and D4 of the Local Plan 2002.

 

2.    It has not been sufficiently demonstrated that a museum reflecting the site’s aviation history could be provided on the site in accordance with Policy SS7 of the Local Plan (Part 1) 2018.

Recommendation

 

RECOMMENDATION A:

 

That, subject to the completion of a S106 agreement to secure a Landscape Ecological Management Plan to address management of the site in perpetuity by the 05/05/2019, and subject to conditions 1 – 3 and informatives 1 – 5, that permission be GRANTED.

 

RECOMMENDATION B:

 

That, in the event that the requirements of recommendation A are not met, that permission be REFUSED.

The proposal would therefore conflict with Policies RE1, TD1 and Policy ST1 of the Local Plan 2018 (Part 1).

Proposal

 

Change of use of land to gypsy / traveller site to provide: 7 private pitches, each including 1 dayroom and 1 mobile home; Parking area for touring caravans to also be used as seasonal transit pitches; with associated hardstanding and landscaping (as amplified by information received 12/11/2018).

 

Recommendation

 

That permission be REFUSED.

 

AND

 

The exempt recommendation set out in the report be agreed.

Decision

 

RESOLVED that permission be REFUSED for the following reasons:

 

1.      Reason

          The proposed development, by virtue of the number of pitches, its location and form, would result in an urbanising impact, which would detrimentally harm the character and appearance of the Countryside beyond the Green Belt and AGLV. This would be in conflict with Policies RE2, RE3 and AHN4 of the Local Plan 2018 (Part 1), Policy H paragraphs 25 and 26(b) of the Planning Policy for Traveller Sites (PPTS) 2015 and paragraph 170 of the NPPF 2018.

 

2.      Reason

The size of the site would dominate the local community and would give rise to a level of activity that would be detrimental to the amenities of the neighbouring residential properties. This would be in conflict with Policy TD1 of the Local Plan 2018 (Part 1), retained Policies D1 and D4 of the Local Plan 2002 and paragraph 14 of the Planning Policy for Traveller Sites (PPTS) 2015.

 

3.      Reason

          The proposal would constitute an unsustainable form of development, in that it would not provide homes for the applicants with accessible local services that reflect the community's needs and support its health, social and cultural wellbeing. The proposal would also fail to contribute to enhancing the natural environment in conflict with Policies TD1 and ST1 of the Local Plan 2018 (Part 1) and paragraphs 108a and 110a of the NPPF 2018.

 

AND

 

The exempt recommendation set out in the report be agreed.
