Cllr Baker had made a representation on item A1, Orchard Farm, in a personal capacity. In view of this, she withdrew from the meeting while the application was considered.

 

Beth Howland-Smith, Development Manager, declared a pecuniary interest in items B2, White Gates, and B3, 14 The Manor, and left the chamber while these items were considered.

Proposal

 

Erection of 9 dwellings including 7 affordable with associated vehicular access and parking following demolition of existing farm outbuildings and stables (as amended by plans received 08/10/2019).

 

Recommendation

 

That, subject to completion of the S106 agreement, to secure the provision of the affordable housing (including mix, tenure, model of affordable rent, nominations agreement process), and SuDS and off-site drainage works within 3 months of the date of the committee resolution, and subject to conditions 1 – 25 and informatives 1 – 13, permission be GRANTED.

RESOLVED that permission be GRANTED subject to completion of the S106 agreement, to secure the provision of the affordable housing (including mix, tenure, model of affordable rent, nominations agreement process), and SuDS and off-site drainage works within 3 months of the date of the committee resolution, and subject to conditions 1 – 25 and additional conditions 26 – 27 noted below, as well as informatives 1 – 13.

 

26.       Condition:

Prior to the first occupation of the dwellings hereby permitted, the highest available speed broadband infrastructure shall be installed and made available for use unless otherwise agreed in writing by the Local Planning Authority.

 

Reason:

To ensure sustainable construction and design in accordance with Policy CC2 of the Local Plan (Part 1) 2018.

 

27.       Condition:

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any other Order revoking or re-enacting that Order with or without modification), no development as defined within Part 1 of Schedule 2, Classes A-F inclusive of that order, shall be erected on the site without the written permission of the Local Planning Authority.

 

Reason:

In the interest of the character and amenity of the area and to protect the openness of the Green Belt in accordance with Policies TD1 and RE2 of the Local Plan 2018 (Part 1) and retained Policies D1 and D4 of the Local Plan 2002.

Decision

 

RESOLVED that the application be REFUSED for the following reasons:

 

1.    The development results in a materially larger building on the site and therefore represents inappropriate Green Belt development. No very special circumstances have been demonstrated to outweigh the harm to the openness of the Green Belt. The development therefore conflicts with Policy RE2 of the Local Plan (Part 1) 2018 and the NPPF 2019.

 

2.    The development by reason of its scale, visual prominence and design results in less than substantial harm to the Conservation Area. This harm has not been justified and is not outweighed by the public benefits. The development therefore fails to accord with Policy HA1 of the Local Plan (Part 1) 2018, retained Policy HE8 of the Local Plan 2002 and the NPPF 2019.
