Planning Performance and the Government target on quality on planning decision making will now be a standard item on the Area Planning Committee agenda. This was an agreed recommendation at Executive on 28 November 2017 and is part of the Development Management Service Improvement Plan.

Proposal

 

Outline Application with some matters reserved (with Access, Layout and Scale to be determined) for the erection of 15 dwellings with associated car parking/garaging following the demolition of existing equestrian, commercial and residential buildings (as amplified by Design Code received 15/02/2018).

 

Recommendation A

 

That, subject to the completion of a Section 106 agreement to secure appropriate contributions towards off-site highway works, a commuted sum towards affordable housing, and adherence to a design code as part of any reserved matters application; conditions and informatives, permission be GRANTED.

 

Recommendation B

 

That, in the event that a Section 106 agreement is not completed within 6 months of the date of the resolution to grant outline permission, permission be REFUSED.

Proposal

 

Outline Application with some matters reserved (with Access, Layout and Scale to be determined) for the erection of 15 dwellings with associated car parking/garaging following the demolition of existing equestrian, commercial and residential buildings (as amplified by Design Code received 15/02/2018).

 

Decision

 

RESOLVED that the permission be REFUSED for the following reasons:

 

1.    The application site is in an isolated location and the proposed development would not fall within any of the circumstances set out in paragraph 79 of the NPPF 2018. The proposal would therefore result in the provision of isolated dwellings, in conflict with paragraph 79 of the NPPF 2018.

 

2.    The proposal, by virtue of the number of dwellings, its density, scale and suburban layout, would result in an overdevelopment of the site and a harmful impact on the rural character of the surrounding area. The proposal would fail to satisfactorily conserve the landscape character and scenic beauty of the AONB and AGLV. The proposal would therefore fail to comply with Policies RE3 and TD1 of the Local Plan 2018 (Part 1), retained Policies D1 and D4 of the Local Plan 2002 and paragraphs 127 and 172 of the NPPF 2018.

 

3.    The proposal would have a greater impact on the openness of the Green Belt than the existing development and would fail to preserve the openness of the Green Belt. No Very Special Circumstances have been demonstrated and, as such, it would not fall within any exceptions set out in paragraphs 145 and 146 of the NPPF 2018. The proposal would therefore comprise inappropriate development in the Green Belt, in conflict with Policy RE2 of the Local Plan 2018 (Part 1) and the NPPF 2018.

 

4.    In the absence of a legal agreement to secure off-site highway improvement works to mitigate the impact of traffic generated by the development, the proposal would have an unacceptable impact on the safety of the surrounding highway network. The application therefore fails to meet Policy ST1 of the Local Plan 2018 (Part 1) and the transport requirements of the NPPF 2018.

 

5.    In the absence of a legal agreement to secure a commuted sum towards affordable housing, the proposal would fail to make a contribution towards sustainable, inclusive and mixed communities and would be contrary to Policy AHN1 of the Local Plan 2018 (Part 1) and the requirements of paragraph 50 of the NPPF 2018.
