Disclosure of Interests

To receive from Members declarations of interests in relation to any items included on the Agenda for this meeting in accordance with the Waverley Code of Local Government Conduct.

Minutes:

Cllr Kika Mirylees declared that she had submitted a personal objection to the application WA/2018/2161, Land at 24 Burnt Hill Road, and would withdraw from the meeting and take no part in that item.

 

Cllr John Robini and Cllr David Beaman declared a non-pecuniary interest in relation to application WA/2018/2161, Land at 24 Burnt Hill Road, as they were both acquainted with Mr Seal who lives adjacent to the application site and had objected to the planning application.

 

Cllr David Beaman declared a non-pecuniary interest in relation to application WA/2019/0116, Land at River Lane, Farnham, as he was acquainted with Mr Aston who lived adjacent to the application site and had objected to the planning application.

The following questions were received in accordance with Procedure Rule 10. The questions and the responses provided by Planning and Legal Officers were circulated to the Committee and the correspondents prior to the Committee meeting.

 

1). The following question has been received from Mr Graham Aston, of Farnham:

 

“Q1: The letter addressed to Elizabeth Simms from W S Planning & Architecture dated 14 August 2018, on the second page, refers to “Your Council approached our client ........ “. As the location and supply of additional gypsy / traveller pitches cannot be demonstrated and has not been met by WBC, this must be a “primary” concern of the Council. Therefore this matter must have been discussed in an Ordinary Council meeting attended by the Chief Executive [presumably prior to 14th August 2018], and I would like the minute taken at that meeting to be read out by the Chair of this meeting so that we are aware of what was agreed. This should be available under the Freedom of Information Act.”

 

Response:

The Council did approach traveller site owners as part of the work to consider potential traveller sites for allocation in Local Plan Part 2 to meet traveller accommodation need.  Endorsement of the approach to traveller accommodation was taken when Local Plan Part 1 was adopted on 20th February 2018.  Adoption of the Plan followed its formal examination. 

 

Policy AHN4 of Local Plan Part 1 states that “Provision shall be made for Gypsies, Travellers and Travelling showpeople in accordance with the Waverley Traveller Accommodation Assessment” and “Specific sites to meet the identified need within the Borough will be allocated within Part 2 of the Local Plan; Site Allocations and Development Management Policies”. The Traveller Accommodation Assessment (TAA) 2017 was carried out in line with the government’s Planning Policy for Traveller sites (PPTS) August 2015. Paragraph 7 of the PPTS states:

 

In assembling the evidence base necessary to support their planning approach, local planning authorities should:

 

a)    pay particular attention to early and effective community engagement with both settled and traveller communities (including discussing travellers’ accommodation needs with travellers themselves, their representative bodies and local support groups).

b)    cooperate with travellers, their representative bodies and local support groups; other local authorities and relevant interest groups to prepare and maintain an up-to-date understanding of the likely permanent and transit accommodation needs of their areas over the lifespan of their development plan, working collaboratively with neighbouring local planning authorities.

c)    use a robust evidence base to establish accommodation needs to inform the preparation of local plans and make planning decisions.

 

The TAA established that there was a need for traveller accommodation in the Borough.

Any Relevant Updates to Government Guidance or Legislation Since the Last Meeting

Officers to update the Committee on any changes to the planning environment of which they should be aware when making decisions.

Minutes:

Officers reported that updated Guidance on the Habitats Regulations had been issued  on 27 July 2019, which was available on the National  Planning Policy Guidance website. The update clarified the effect of recent European case law (the “Sweetman Ruling”) on the Habitats Regulation Appropriate Assessment procedure. Waverley’s procedures had been reviewed and updated in 2018 in response to the ruling, and therefore was already compliant with the new guidance.

 

This would be dealt with more fully in a Briefing for Planning Committee Members, which was being arranged by officers.

1.      The proposed dwelling and formation of a new entrance would, by way of its siting and layout be contrary to the surrounding character and pattern of development in conflict with Policy FNP 1 and 8 of the Farnham Neighbourhood Plan 2017, TD1 of the Local Plan Part 1 2018, and  paragraphs 127, 128 and 130 of the NPPF 2019.
