Planning Performance and the Government target on quality on planning decision making will now be a standard item on the Area Planning Committee agenda. This was an agreed recommendation at Executive on 28 November 2017 and is part of the Development Management Service Improvement Plan.

Decision

RESOLVED that the application be REFUSED (against the officer recommendation) for the following reasons:

 

1.    The development would appear cramped and contrived resulting in the overdevelopment of the site that would be out of character with the surrounding area. This would be contrary to Policies FNP1 and FNP16 of the Farnham Neighbourhood Plan 2017, Policy TD1 of the Waverley Borough Local Plan Part 1 2018, Policies D1 and D4 of the Waverley Borough Local Plan 2002 and the Farnham Design Statement 2010.

 

2.    The proposed development would result in a harmful pattern of overlooking of neighbouring no.77, no.79 and no.81 Shortheath Road and Jaipers on Sunnydale land and a poor level of amenity for future occupants contrary to the objectives of Policies FNP1 and FNP16 of the Farnham Neighbourhood Plan 2017, Policy TD1 of the Waverley Borough Local Plan Part 1 2018, Policies D1 and D4 of the Waverley Borough Local Plan 2002 and Waverley Borough Council’s Residential Extensions SPD.

Proposal

 

Erection of a detached dwelling with associated access, parking and landscaping following demolition of existing garage.

 

Recommendations

 

RECOMMENDATION A:

 

That, subject to conditions 1 – 8, informatives 1 – 7 and a S106 agreement to secure contributions for the mitigation for the impact on the SPA, permission be GRANTED.

 

RECOMMENDATION B:

 

That, in the event that the requirements of Recommendation A are not met within 6 months of the date of the resolution to grant permission, then permission be REFUSED.

Erection of a detached dwelling with associated access, parking and landscaping following demolition of existing garage

 

Decision

RESOLVED that the application be REFUSED (against the officer recommendation) for the following reasons:

 

1.    The proposed development by reason of its scale and the subdivision of the residential garden represents inappropriate back land development, harmful to the spacious character of the surrounding area, contrary to the objectives of Policies FNP1 of the Farnham Neighbourhood Plan 2017, Policy TD1 of the Waverley Borough Local Plan Part 1 2018, Policies D1 and D4 of the Waverley Borough Local Plan 2002 and the Farnham Design Statement 2010.

 

2.    The Proposed dwelling would be within 15m of the Ancient Woodland to the south-west of the site and therefore fails to provide an adequate buffer zone in line with the Forestry Commission’s Standing advice. It has therefore not been sufficiently demonstrated that the proposed development would not result in material harm to the Ancient Woodland and would be contrary to Policy NE2 of the Local Plan (Part 1) 2018, retained Policies D6 and D7 of the Local Plan 2002, Paragraph 175 of the NPPF 2018 and the guidance contained within the NPPG.

 

3.    The proposal (in combination with other projects) would have a likely adverse effect on the integrity of the Thames Basin Heaths Special Protection Area (SPA) in that it is now widely recognised that increasing urbanisation of the area around the SPA has a continuing adverse effect on its interest features, namely Nightjar, Woodlack and Dartford Warbler, the tree internationally rare bird species for which it is classified. Accordingly, since the planning authority is not satisfied that Regulation 64 of the Conservation of Habitats and Species Regulations 2017 (The Habitat Regulations) applies in this case, it must refuse permission in accordance with Regulation 61(5) of the Habitats Regulations and Article 6(3) of Directive 92/43/EE. The proposal conflicts with Policy NRM6 of the South East Plan, paragraph 118 of the NPPF 2012, Policies NE1 and NE3 of the Local Plan (Part 1) 2018, Policies FNP12 and FNP13 of the Farnham Neighbourhood Plan 2017 and the Thames Basin Heaths SPA Avoidance Strategy Review (2016).

Application under Regulation 3 of the Town and Country Planning General Regulations 1992 for erection of a building to provide 2 flats with associated works.

 

Recommendation

 

That, subject to conditions 1 – 14, informatives 1 – 7 and securing the appropriate mitigation in relation to the Thames Basin Heath SPA, permission be GRANTED.

Application under Regulation 3 of the Town and Country Planning General Regulations 1992 for erection of a building to provide 2 flats with associated works

 

Decision

RESOLVED that the application be REFUSED (against the officer recommendation). Reasons for refusal are noted below:

 

1.    The proposed development would be cramped and contrived, with inadequate amenity space and of poor urban design, harmful to the charater and the appearance of the area. This would be contrary to FNP1 of the Farnham Neighbourhood Plan 2017, TD1 of the Local Plan (Part 1) 2018 and retained Policies D1 and D4 of the Local Plan 2002.

 

2.    The proposed development would result in the displacement of parking from the existing parking area to the surrounding area which would be detrimental to highway safety, contrary to Policy ST1 of the Local Plan (Part 1) 2018 and Policy FNP30 of the Farnham Neighbourhood Plan 2017 and paragraphs 109 and 110 of the NPPF.
