Any Relevant Updates to Government Guidance or Legislation Since the Last Meeting

Officers to update the Committee on any changes to the planning environment of which they should be aware when making decisions.

Minutes:

Officers reported that updated Guidance on the Habitats Regulations had been issued  on 27 July 2019, which was available on the National  Planning Policy Guidance website. The update clarified the effect of recent European case law (the “Sweetman Ruling”) on the Habitats Regulation Appropriate Assessment procedure. Waverley’s procedures had been reviewed and updated in 2018 in response to the ruling, and therefore was already compliant with the new guidance.

 

This would be dealt with more fully in a Briefing for Planning Committee Members, which was being arranged by officers.
